A. The Tribal Council has found it to be in the best interest of the Tribe to provide elder and disabled assistance to enrolled Tribal Members of the San Juan Southern Paiute Tribe. This program will assist the Elder Tribal Members and Disabled Tribal Members of the San Juan Southern Paiute Tribe to combat the economic and cultural barriers that have restricted these individuals from accessing desperately needed services.
B. Tribal Elders have been subject to poverty and deprivation for a significantly longer time period than most other enrolled Tribal Members. Tribal Elders have significantly greater health problems as they age, and as such, will require additional resources and care.
C. Disabled Tribal Members have been subject to poverty and deprivation that is significantly more difficult to combat due to limitations in physical and mental health, and the Tribal Council has determined that additional resources are required to assist Disabled Tribal Members.
D. Through this Chapter, the Tribal Council institutes the Elder and Disabled Assistance Program, guided by the appropriate laws, policies and procedures applicable through federal laws and regulations.
E. The Elder and Disabled Assistance Program established in the Chapter complies with the General Welfare Policy found in Chapter 1 of this Title of this Code.

Pursuant to the authority vested in the San Juan Southern Paiute Tribal Council by virtue of its inherent powers of self-government, and its authority to provide for the health, wealth and safety, morals and welfare of the San Juan Southern Paiute Tribe, the Tribal Council hereby establishes the Elder and Disabled Assistance Program, and enacts this Chapter which shall establish the purposes, powers and duties of the Elder and Disabled Assistance Program.

For purposes of this Chapter, the definitions provided in § 101 of Chapter 1 of this Title shall apply and the following additional terms as applied to this Chapter shall mean:
A. “Disabled Tribal Member” means an Enrolled Tribal Member with a short-term or long-term disability as diagnosed by a medical professional.
B. “Elder Tribal Member” or “Elder” means an enrolled Tribal Member at least 55 years of age or older or the age otherwise required of any federal, state or other funding source where those specifically identified funds are utilized to carry out the objectives of the Elder and Disabled Assistance Program.
C. “Elder and Disabled Assistance Program Application” means the application approved by the Tribal Council to support the purposes set forth in this Chapter, including all supplemental documentation required to be included with the Application.
D. “Elder and Disabled Assistance Program” means the Tribal Government Program established by this Chapter.
